Agreement to Terms
By accessing or using Damper's services, you agree to be bound by these Terms of Service and our Privacy Policy. If you disagree with any part of these terms, you may not access our service.
Service Description
Damper provides a feedback collection platform that enables businesses to collect, organize, and prioritize user feedback. Our service includes a feedback widget, voting system, public roadmap, changelog, and team collaboration tools.
Account Registration
To use our service, you must register for an account. You agree to:
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Promptly notify us of any unauthorized account access
- Accept responsibility for all activities under your account
Acceptable Use Policy
You agree not to use our service to:
- Violate any applicable laws or regulations
- Submit spam, fraudulent feedback, or manipulate votes
- Transmit malware, viruses, or harmful code
- Attempt to gain unauthorized access to our systems
- Impersonate others or misrepresent your affiliation
Intellectual Property
The Damper service, including its software, design, logos, and content, is owned by Damper and protected by intellectual property laws. You retain ownership of your content (feedback, roadmap items, changelogs) but grant us a license to process it as needed to provide our service.
Payment Terms
Paid plans are billed monthly or annually via Stripe. Prices are in USD and exclude applicable taxes. You can cancel your subscription at any time; access continues until the end of your billing period. Refunds are provided at our discretion.
Data Processing
By using our service, you appoint Damper as a data processor for visitor data collected through the feedback widget. You remain the data controller and are responsible for obtaining necessary consents from your website visitors. See our Privacy Policy for details on how we handle data.
Limitation of Liability
To the maximum extent permitted by law, Damper shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
Termination
You may terminate your account at any time through your dashboard. We may suspend or terminate accounts that violate these terms. Upon termination, your data will be scheduled for deletion after a 30-day grace period.
Governing Law
These terms are governed by the laws of the European Union and the Republic of Slovenia. Any disputes shall be resolved in the courts of Slovenia, unless mandatory consumer protection laws in your country provide otherwise.
Changes to Terms
We may modify these terms at any time. We will notify you of material changes via email at least 30 days before they take effect. Continued use of our service after changes constitutes acceptance.
